Billing Terms

Content Standards and User Responsibility

User Responsibility

You are solely responsible for ensuring that all prompts you create and content you generate through EnginifyAI comply with:

Applicable laws and regulations
Third-party AI provider terms of service
Professional and ethical standards
Intellectual property rights of others

No Monitoring

We do not monitor, review, or pre-screen user prompts or generated content. You use the platform at your own discretion and responsibility.

Your Acknowledgment

By using EnginifyAI, you acknowledge that:

You are responsible for your use of AI models and generated content
We are a platform provider, not a content moderator
Third-party AI providers may have their own monitoring and enforcement policies

Intellectual Property Rights

User Content

Ownership: You retain ownership of prompts, prompt data, and content you create
License to Us: You grant us a limited license to process your content to provide the Service
Responsibility: You are responsible for ensuring you have rights to any content you input
Generated Content: You own the output generated from your prompts

Platform Content

Our IP: EnginifyAI’s software, interfaces, and proprietary features remain our property
Templates: Pre-built templates and features are licensed for your use within the platform
Trademarks: Our logos, trademarks, and branding materials are protected
Feedback: Any feedback you provide may be used to improve our services

Third-Party Content

AI Providers: Generated content is subject to third-party AI provider terms
Integrations: Third-party integrations are governed by their respective terms

Data Processing and AI Services

Third-Party AI Providers

Processing: Your prompts are processed by third-party AI providers (Anthropic, Google, OpenAI, xAI)
Data Protection: All providers are bound by strict data protection agreements
No Training Use: Your data is not used to train third-party AI models
Provider Terms: Usage subject to individual AI provider terms of service

Data Security

Encryption: All data encrypted in transit and at rest
Access Controls: Strict authentication and authorization protocols
Monitoring: Continuous security monitoring and threat detection
Compliance: GDPR, and other applicable security standards

Data Retention

Active Accounts: Data retained while your account is active
Account Deletion: ALL personal data permanently deleted within seconds of account deletion confirmation
Legal Requirements: Minimal audit logs may be retained to comply with legal obligations (these contain no personal content)
Backup Systems: When you delete your account, data is immediately purged from all backup systems through our automated deletion process

Important Note: Account deletion is immediate, comprehensive, and irreversible. We recommend exporting any important data before deleting your account. Once deleted, your data cannot be recovered.

User Accounts and Security

Accurate Information: You must provide accurate and complete registration information
Account Security: You are responsible for maintaining account security
Authorized Use: Only you may use your account; sharing is prohibited
Age Requirements: Users must be at least 18 years old or have parental consent

Account Termination

By You

You may terminate your account at any time through account settings.

By Us

We may terminate accounts for Terms violations, or other reasons with or without notice.

Effect of Termination

Your access to the Platform will be immediately suspended
ALL account data will permanently be deleted if canceled
Deletion is comprehensive, covering all user content, settings, and associated data
This deletion is immediate and irreversible – your data cannot be recovered
Active subscriptions will be cancelled (no refund for unused credits unless required by law)

Data Export

We strongly recommend exporting your data before termination. After deletion confirmation, data cannot be recovered.

Platform Availability and Performance

Service Level

Uptime: We strive for 99.9% uptime but do not guarantee uninterrupted service
Maintenance: Scheduled maintenance with advance notice when possible
Performance: Best efforts to maintain optimal performance and response times

Service Limitations

Third-Party Dependencies: Service may be affected by third-party provider availability
Rate Limits: API and usage rate limits apply based on subscription tier
Geographic Restrictions: Service availability may vary by location

WE DO NOT WARRANT THAT:

The Service will be uninterrupted, secure, or error-free
Results obtained from the Service will be accurate or reliable
Quality of content generated will meet your expectations
Third-party AI providers will be continuously available

Liability Limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Total Liability: Our total liability is limited to amounts paid by you in the 12 months preceding the claim
Excluded Damages: We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption
Third-Party Services: We are not liable for third-party AI provider performance, outputs, availability, or any costs associated with their services
User Content: We are not liable for user-generated content, its accuracy, or its consequences
Data Loss: We are not liable for data loss, though we maintain reasonable backup procedures

Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless EnginifyAI, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising from or related to:

Dispute Resolution

These Terms are governed by the laws of the State of California, United States of America, without regard to conflict of law principles.

Dispute Process

Step 1: Informal Resolution

Contact our support team first to attempt resolution. Many disputes can be resolved quickly through direct communication.

If informal resolution fails, disputes may be submitted to non-binding mediation before proceeding to arbitration or litigation.

For disputes that cannot be resolved informally or through mediation, binding arbitration may be required for certain disputes as permitted by law.

Class Action Waiver

YOU AND ENGINIFYAI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Jurisdiction

Any legal proceedings that are not subject to arbitration must be brought exclusively in the state or federal courts located in California, United States of America. You consent to personal jurisdiction in these courts.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features, constitute the entire agreement between you and EnginifyAI regarding the Service.

Modifications

Term Updates: We may modify these Terms from time to time
Notification: Material changes will be posted on our website and emailed to registered users at least 30 days before taking effect
Continued Use: Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms
Right to Discontinue: If you do not agree to modified Terms, you must discontinue use of the Service

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Assignment

By Us: We may assign these Terms or our rights and obligations under these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets
By You: You may not assign your rights or obligations under these Terms without our prior written consent

Relationship

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and EnginifyAI. You are an independent user of the Service.
